law of England in force on the 5th of April,1843, has
been introduced into llong Kong by the local Legislature
it is contended by the Colonial Office that it is open
to that Legislature to modify or limit any provisions
of English law so introduced; that this power has
been asserted by that Legislature in section 5 of the
Supreme Court Ordinance, 1873, and (quite apart from any such assertion) is included in its general power to
legislate for the peace, order and good government of
the Colony (see Letters Patent of 14th February, 1917,
clause VII and similar provisions in previous Lettera
Patent, and see also, as to the significance of "peace,
order and good government" the Judgment of the Privy Council in Riel v.the Queen L.R.10 App.Cas.at p.678);
that the power to alter the law of England in its
application to the Colony is limited only by the
provisions of the Colonial Lawe Validity Act as to Acts
of Parliament "extending to the Colony";
and that no
Hong Kong Ordinance is void under that Act or otherwise
for repugnancy to the common law of England including
the law relating to the writ of Habeas Corpus.
