Referring to your letter of the 22nd instant No.34033/IS.

we have got into communication with Mr. Sharp K.C., 0.B.E., and he has kindly consented to confer with us, if and when the appellant

enters an appearance in this appeal.

2. It occurs to us that perhaps the most useful course would

be to retain Mr. Sharp as Counsel for the respondent, as he was

concerned in the case in the local Court, and it would appear to us

to be only reasonable to pay him a fee, if he assists the Hong Kong

Government in this country.

3. You will recollect that Mr. Upjohn K.C. has been retained

as leader, and he would therefore lead Mr. Sharp. It would also be

necessary, in order to comply with the etiquette of the Bar, that a Junior should be briefed. The employment of Mr. Sharp would there- fora entail an additional fee being paid, and we will defer doing s0

until we receive your instructions.
