"ith reference to your letter of 13th August, (44152/1919) forwarding copy of a despatch from the Officer Administering the Government of Hong Kong, submitting an enquiry whether Mr. C.W. Halk, who is of Swedish birth, may act in the capacity of last er of a British Ship, I am directed by the Board of Trade to state for the information of Viscount Millner that they observe that the Government of Hong Kong have adopted by a notification in the Government Gazette a rule applying Defence of the Realm Ragu- lation 37 D., to ships sailing from Hong Kong.
Defence of the Realm Regulation 37 D. as in force in this country, debars a person from acting in the capacity of Master of a British Ship, unless he is British born and born of parents who were at the time of his birth British either by birth or naturalisation, but the Regulation also makes a pro- vision giving the Departments concerned in admin- istering it, 1.0. the Admiralty and the Board of Trade, power to allow an exception to the rule, this power being served for the purpose of dealing with any case of hardship that may arise in ad- ministering the Regulation and allowing a thor- oughly trustworthy person, despite birth and parentage, on good cause shown to act as Master.

The Board have no copy of the Regulation as made by the Government of Hong Kong, and, there- fore, do not know in what manner it has been applied, but they presume that the Government can under their Regulation make an exception, if they see
