With reference to your letter of 14th May (24099/19) transmitting a transcript of an Ordinance passed by the Legislature of Hong Kong entitled "Ordinance to "prohibit the carrying on of banking business for the "benefit of or under the control of certain persons",
as directed by the Board of Trade to state for the information of Viscount Milner that they see no objection;
having regard to the definition of "prohibited person"
to the substitution of the expression "prohibited" for
"enemy" the word used in the Imperial Statute.

I am at the same time to inform you that the Board
of Trade agree with your view that the use of the word "enemy" in subsection 2 (d) makes the terms of that subsection inconsistent with those of subsections (a) (b)
and (c) which do not define "enemy controlled
