I am directed by Earl Curzon of Kedleston to

acknowledge the receipt of your letter of the 19th

ultimo, 57707/18, regarding a proposal to lease for

reclamation and building, a small area on the Northern

boundary of the New Territory of Hongkong.

Lord Curzon desires me to state, in reply, that it

appears clear to him that, while the area in question seems to be at present outside the limit of Chinese territory, its reclamation would effect a local alteration

of the high water mark which is stated to form the

boundary along the shores of Mirs Bay and Deep Bay, and

if this reclamation were challenged by the Chinese

Government, he thinks it would be impossible to contend

that the expression "high water mark" means a fixed

unalterable/
