With reference to your letter 52323/19 of the 16th instant enclosing a letter from the Board of Trade of the 9th instant relative to the case of Mr.C.W.Falk, and to previous correspondence, I am commanded by My Lords Commissioners of the Admiralty to acquaint you, for the information of the Secretary of State for the Colonies that they conour in the suggestion of the Board of Trade that the Defence of the Realm Regulation 37D, is not enforceable against any person who contravenes it unless such person comes within the jurisdiction of the United Kingdom. Independently however of the provisions of Defence of the Realm Regulation 37D., it appears that clause 5 of the new Aliens Restriction Bill now before Parliament, if passed in its present terms, will disentitle Mr.Falk to command unless and until he becomes naturalised.
2. Their Lordships would, therefore, suggest that Mr.Falk would be well advised to renew his application for naturalisation whether in this country or in Hong Kong, as soon as circumstances permit. They note that lack of the necessary qualification of residence has hindered his naturalisation up to the present.
