question that some principle of public interest
or policy must have been concerned to underlay
such motive it is clear that the demands of
natural justice require that, if it was necessary
to over-ride the claims of your Petitioners in
the public interest that your Petitioners should
be compensated at the public expense.
(8) Your Petitioners feel themselves aggrieved by
the action of the Govemment and submit they
have good grounds for such grievance especially
since they understand that the reason why their
claims were over-riden was because of the desire
of the Government that the District of Samshuipo
in Kowloon should be developed and of the view
of the Govemment that the awarding of the service
to the successful tenderers would conduce to this
object by reason of the fact that the successful
tenderers had invested a large sum in land and
buildings at Samshuipo and would naturally be
concemed to develop the traffic facilities
there in their own interest and perhaps to the
prejudice of the public travelling to Yaumati and
kongkok.
Your Petitioners therefore humbly
pray that you may be pleased to
direct that compensation be paid
to your Petitioners for the loss
they have suffered owing to the
service being awarded to others
over their heads without any adequate reasons being vouchsafed
