With reference to the letter from this Department of the 12th instant (No.201294/10) enclosing a copy of the evidence which led to the inclusion of the Handels Maatschappij Transmarina in Class "A" of the General Black List, I am directed by Mr. Secretary Balfour to transmit, herewith, for such reply as Mr. Secretary Long may consider desirable, a letter in original from Messrs. De Trey & Company Ltd.

2. Since the inclusion of the Transmarina" in the Black List a great number of letters have been detained by the Censorship Authorities showing that large quantities of goods have been ordered by the Black-listed firm in Holland for export to its branches at Buenos Aires, Shanghai and Hong Kong.

3 In view of the extent of the business involved and the large number of British firms affected and the principle at stake, Mr. Balfour considers it most desirable that a uniform attitude should be adopted so far as possible towards all the branches of this fim in order to secure both that the head office is penalized to the fullest degree possible and that the same treatment is extended to the British firms concerned.

After consultation, the War Trade Department, the Transhipment Department and the various sections of this Department which are concerned have accordingly agreed to grant no facilities whatsoever for any shipment rade by the Dutch house to its Buenos Aires and Shanghai branches, unless the penalty inflicted on the British firm involved by stopping goods already ranuractured would be in undue proportion to that inflicted on the Dutch firm.

i As a large proportion of these orders are for shipment to the Hong Kong branch of the "Transmarina", I am to ask whether Ir. Secretary Long would be prepared to cause similar treatment to be accorded to the Hong Kong branch and to warn any British firm applying to him that it would be well advised not to entertain any orders for shipment to that branch.

I am to suggest also that the War Trade Department be requested to refuse export licences in respect of goods to be exported to the Hong Kong branch.
