(c) Officers appointed since 31st Dec 1910. Whether these are either permanently employed in the service of the Hongkong Government seems undecided. Or it is possible to argue that they are (a) but not (b) in practice, or that they are (b) but not (a) - or that they are both (a) & (b), or that they are neither.
But as long (b) is doubtful, the legal right to compel them to become contributors by HK legislation is doubtful.
In the case of above, if they are both (a) & (b), they should have been contributors on some given date - presumably the date of transfer of their service to the Hongkong Government - that of their appointment to the Postal Agencies. And should have been contributors, whether they wanted to or not, by that date. But as they were not forced to contribute at the time, it would be against the principle to force them into the Scheme now.
Whatever their status under the Ordinance as discussed above, they could, if admissible as members of the W.D. scheme, be forced to become contributors as part of their conditions of service.
The persons who are employed, not by the Government, but by the Agent. These could not be admitted as contributors without subverting the principle of the Scheme. They are not Government officers at all.
