With reference to my telegram of the 10th. September, and previous correspondence, I have the honour to
inform you that I have taken your despatch No. 227 of the
47077 10th. October, 1917, as a positive direction that the trade

marks in question are to be assigned to Messrs. V. and C.
Dunlop unless there be some technical legal obstacle in the
way of such assignment.

The question of policy being thus settled, the only difficulties which I felt were (a) the difficulty
as to what goodwill it would be necessary and possible to assign with the trade marks, and (b) the difficulty of escer-
-taining the proper consideration for the assignment. It was! to meet the former difficulty that I suggested in my despatch.

13607. No. 30 of the 21st. January, 1918, that the goodwill of the
piece goods department of Kessrs. Meyerink and Company should
be assigned to Kesers. W. & C. Dunlop. The objection to that
course would have been that Messrs. Heyerink and Company dealt in other cotton and woollen piece goods besides those of Messrs. W. and C. Dunlop, though they had no trade marks of their own in those classes. I may say that the six trade
marks registered in the joint names of Messrs. Meyerink & Co. and Kesars. V. & C. Dunlop are registered in classes 24 and 34
