I have the honour to acknowledge the receipt of your Despatch No .222 of the 29th of July regarding the action for libel brought by Mr. E.W.Hamilton, acting District Officer (South) against the "Hong Kong Daily Press and the China Mail".

2. I fear that I cannot agree with the attitude taken up by your Government in this matter. In my opinion even when a public Officer feels himself constrained to take civil proceedings with regard to some matter arising out of his official conduct and has obtained the Governor's permission to do so, it is in- expedient to take any decision before such pro- ceedings are determined with respect to the payment out of public funds of the costs for which he may become liable in the event of his action not being auccessful.

Apart from legal objections to such

a course, it is necessary on general grounds that I should be satisfied as to the propriety

of the conduct of the Officer concerned before

authorising
