6. It is true that it has been laid down that what outrages

public decency and is injurious to public morals is a misdemeanour

at common law (see the authorities quoted in Roscoe's Criminal

Evidence, 12th Edition, at p.701). Thus it has been held that

keeping a booth for the purpose of showing an indecent exhibition

which the public were invited to enter on payment, (B.v.Saunders,

1 Q.B.D. 15), and the exhibition by a herbalist of a man naked to

his waist and covered with sores, (R.v. Grey, 4 F. & F. 73), have

been held to be indictable offences. It is, however, doubtful

whether the common law misdemeanour would cover the case of some

of the objectionable medical advertisements. As it is advisable

to legislate for the particular case of medical advertisements it

has been thought convenient to deal at the same time with indecent

publications and exhibitions generally

In my opinion this is an Ordinance to which His Excellency

the Governor may properly assent in the name of His Majesty and

on His behalf.
