1. I have the honour to approach you on the question of

Duty Fay in connection with my emoluments as the manager of the

British Section of the Kowloon-Canton Railway.

2. In the negotiations preceding my appointment the

Honourable Colonial Secretary forwarded to me under date of June

14th 1911 a copy of the despatch addressed to you on June 6th by

Fig Treellenoy the Governor requesting sanction for my appoint-

ment on certain terms one of which is as follows:-

(b) "the salary will be equivalent to a rate of

"2800 to £1,000 by £100 triennially approximately,

"but I propose to express it in terms of Duty Pey,

"and to include the post in the new arrangement of

"Sterling Salaries (with Duty Pay) which I am about

"to submit to you in a separate despatch."

and on July 13th I was duly notified of your approval of my

appointment and concluded that the terms contained in the

despatch of June 6th had received your sanction as no further

mention was made of them.

3. From the wording of the above paragraph I sulmit that

my appointment was clearly offered to me at the salary mentioned

on the understanding that when the Duty Pay goheme came into

foroe, Duty Pay would be added. I contend that there can be no

other reading and I was therefore much surprised when I did not

receive Duty Pay on its institution. However during my
