The whole of the very heavy costs of both hearings was borne by the petitioners.
Notice of appeal to the Privy Council by the defendant was given, but was not proceeded with, and the hearing of this action was commenced on December 19th, 1916,
During the course of the winding up proceedings two documents of the utmost importance to the directors depend- -ing this action were produced: these were a receipt for $100,000 and an agreement by which the defendant directors sought to prove that 100 chests of opium belonging to the Company had been transferred to other firma for a bona fide
consideration.
These documents were submitted after the judgment of the Full Court by the Secretary for Chinese Affairs to a Committee of the Chinese Chamber of Commerce.
This Committee were agreed that there was no doubt that both these documents were forgeries.
The proceedings were very protracted and the expenses great and after over 50 days hearing I reported to the Court and to the Government that I was not sufficiently secured to be able to continue the case.
Up to this point the petitioning creditors had been involved in very heavy coats and had expended a sum of not less than $125,000.
