1912 March 12th, I, the acting agent of the Volunteer Fleet in Hongkong

On the 6/19 of this year I was informed by you that the local authorities had informed you of the requisition of the steamer of the Volunteer Fleet "Tobolak" by the British Government to which information I replied by asking you/20 Harch Ho 56/ to take all possible measures in order to annul the requisition and that I will take steps in order to demand the indemnification of the Volunteer Fleet for all losses occasioned by the requisi-

-tion.

By the present I protest in the name of the Volunteer Fleet against the requisition by the British Government of the steamer "Tobolsk", I declare that I consider the requisition to be illegal in view of the fact that the conditions were not previously discussed with the lawful representatives of the Volunteer Fleet in the Far East, the latter were not advised of the action that was being pre- -pared and the seizure was proceeded with in a way not applicable to ships of a friendly nation, as was the "Tobolsk", the Russian flag being substituted by the British flag and the officers and crew being arrested.

I am excessively impeded in my lawful steps before the local authorities with a view to ascertain the reasons for the requisition and the possibility of the withdrawal of the requisition by the fact that the captain is not allowed to hold communications with the shore in a normal

way.

and

b. I reserve to the Volunteer Fleet to myself as the lawful representative of the Volunteer Fleet in Hongkong the right to seek by all means the return of the "Tobolsk" to the lawful owners, the Volunteer Fleet, and to demand from the British Government the indemnification of the Volunteer
