All this seems to me very unsatisfactory,

and I think that the Law Society's proposal provides a solution. Many of the solicitors now here are quite competent

to conduct $5,000 claims from start to finish, under the less technical procedure of the Summary Court. Some will no doubt still prefer to brief counsel if they can secure him but even then the costs would be infinitely less than at present, and the expedition greater.

The work in the Summary Court will un- -doubtedly increase: and may in time afford a promising field for the junior Bar. At present there is no place for budding counsel until he gets into the heavy cases. The two senior men here are not likely to remain very much longer, and there can be no harm in giving the beginners who will be coming out a field for training and exercise.

But I desire particularly to emphasize the point, that I am thinking not of either branch of the pro- -fession nor of their interests or prejudices but rather of that long suffering individual, the business men, whose function it is to be a party to actions and to pay the costs.

The suggested "Short Cause" list may or

may not prove a success. Personally I expect very little from it: because it does not get rid of the main difficulty - that there are never enough counsel I mean, of course, competent counsel to go round.

But in any event this list would not cheapen matters to the small but often quite honest litigant, whom I have particularly in mind.
