With reference to your letter (8351/1917) of the 15th March transmitting a copy of correspondence with Mr. H. C. Arnhold relative to Trade Marks registered in Hong Kong in the name of Arnhold, Karberg and Company, I am directed by the Board of Trade to state for Mr. Long's information that as regards the business of Messrs. Arnhold, Karberg and Company in this country the facts are correctly set out in paragraph 2 of your letter. A large number of Trade Marks are registered in this country in the name of the firm. No application has been made to enter Messrs. Arnhold on the Trade Marks Register as proprietors of the business, and if any such application were made it would have to be dealt with in accordance with the Trade Marks Act, Section 33 of which requires proof of the devolution of the goodwill on the applicants.
