With reference to Sir Conyngham Greene's despatch to you

No. 309 of the 12th of May last, I have the honour to transmit

herewith copy of a Memorandum furnished to His Majesty's

Commercial Attaché at Shanghai by ir. F. J. Norbury, a member

of the Trade Marks Sub-Committee of the China association and a

recognised authority on Manchester "chops", on the subject

of British Trademarks in China.

Hr. Norbury sets out clearly the British case for the

recognition of "priority of user" as opposed to "registration

in applicant's om country" which I understand, constitutes

that divergence of opinion between the Japanese and ourselves

which is the main obstacle to the conclusion of a satisfactory

trademark convention with China.

Mr. Fox has sent a copy of this memorandum to His

Majesty's Commercial Attaché at Tokio in case it may be of use

in our negotiations with the Japanese on trademark questions.
