(a) Section 2 defines "ferry" as widely as possible,
except that it excludes ferries carried on by means
of boats propelled by oars and sails only; (b) Sub-section (2) of this section throws Upen the owner or charterer of any vessel which has been
used for the purpose of an illegal ferry the onus
of proving that he was not entitled to share in
the profits of the ferry or that the vessel was 80
used without his consent or connivance. Every
person who is entitled to share in the profits of
an illegal ferry is to be deemed to maintain such
ferry during the period in respect of which he is
so entitled.
(a) Section 3 provides that no person shall maintain a
ferry in any area to which the section is by regu-
lation declared to apply. This will enable the
regulation of the various ferries, which require
varying treatment, to be taken up piecemeal
(b) Sub-section (2) of this section provides for the
exclusion from this prohibition of ferries whi ch
start from a point or points within the area de-
clared but which are really ferries running from
that point or those points to some place or places
outside the area. This again is intended to
facilitate the separate handling of ferries which
call for distinct treatment.
Section 4 makes the issue of any licence subject to
the absolute discretion of the Governor in Council.
