the enactment of section 6 of the Customs (War Powers) Act, 1915, 5 & 6 Geo. 5, c.31, and section 2 of the Customs (War Powers) (No. 2) Act, 1915, 5 & 6 Gạo. 5, c. 71. It was also noticed that section 1 of the Customs (War Powers) Act, 1916, 5 & 6 Geo. 5, c. 102, seemed to contemplate the forfeiture of goods belonging to omers resident outside the United Kingdom, and that the gazette notioss issued under the seation contained cases where the com- -signors and consignees were both resident in neutral countries. In spite of the apparent adoption of a policy of forfeiture of such cargo in the United Kingdom it was felt that the power was a very unusual one and ought to be exercised with great caution. No steps were taken to enforce my forfeiture under either section until May, 1916, when proceedings were begun in Case No. 1 referred to below. It was then advised that a full opportunity of appearing should be afforded to possible claimants, and it was intended that the case should be a test case. No one, however, appeared to oppose the forfeiture, and the order of forfeiture was made on the 19th. August, 1916. There have been in all four cases of forfeiture under section 11 and no case has any one appeared to oppose the forfeiture. The details of the five cases are given below. All along, caution in the use of the section and the necessity of giving full notice to possible claimmte have been insisted upon. There has been ore proceeding under section 10 of the Ordinance. The details of this onse are also given below.

With regard to paragraphs 3 and 4 of the Secretary of 4J45 State's Despatch of the fth. February, 1916, it should be pointed out that the provisions of section 11 were extended to persons en the Statutory List by section 4 of the Trading with the Enemy (Extension of Powers) Ordinmce, 1916, Ordinance No. 4 of 1916. The action in Cases Nos. 4 md 5 below was based on this extension of powers and was not taken in the belief that persons on the Statutory List were enemies within the mewing of section 11 of Ordinance Na. 22 of 1915.
