We are acting for the personal representatives and trustees
of the Will of the late Joao Francisco Braga of whose Will Probate
was granted from the Supreme Court of Hong Kong on the 81st January
1916, The duty on the Probate became payable on the 23rd February
1914 and under the provisions of the Stamp Ordnance 1901 seo. 24
a penalty of treble the Probate duty was incurred on account of
the delay for a period of more than one year in obtaining the
Probate. The delay was due to the son of the deceased, who had
the management of the estate in his hands in this country having
joined His Majesty's forces immediately on the outbreak of the War
and being unable to attend to matters connected with his father's
estate and also to the difficulty of communication with Hong Kong
where the properties were situate.
The parties petitioned the Governor-in-douncil in Hong Kong
for a remission of the penalty, and after considering the said
petition the Governor-in-Council granted a remission of half the
penalty duty.
