With regard to voluntary winding up and reconstruction of China Companies with enemy shareholders, Crown Advocate advises that shares in new Company (or without option to take further issues) cannot be given to enemy shareholders even if new scrip is retained until the end of the War. Crown Advocate considers that in accordance with reconstruction resolutions, enemy shares and all rights pertaining to shares should be retained by liquidator and proceeds paid to enemy dividends account.
