In my despatch No 243 Secret of the 12th ultime I
had the honour to suggest the issue of an Order-in-
Council conferring greater powers on His Majesty's
Minister in respect to the deportation of diens sus
pected of sedition and I stated that pir H. de Sausmarez
who was absent in Japan had sent a short telegram expres
sing general concurrence in the Asistant Judge's views
which were embodied in the above mentioned despatch,
I have now received a despatch from is Majesty' Judge, copy of which I have the heneur te enclose here-
with, in which it will be seen that, while quite pre- pared to agree to more extensive powers being conferred
on the executive as a temporary war measure, he doubts the legality of making such powers permanent and that he feels that the existing powers of the Court have not bea sufficiently tested to show that they have been inade-
quate to deal with any case that has yet arisen.
In view of Sir h. de Saumarez' opinion and the
fact that the chief difficulty seems to lie in making
the powers sought for permanent, it might perhaps be well to treat the issue of the Order-in-Council as a temporary war expedient, leaving the question of dealing with Indien sedition after the war to be raised again
later,
