A Chinese constable deposed for the Crown that certain labels were found lying on the floor of the Baggage Room, apparently torn from these boxes. I inspected the boxes and formed the opinion that the removal of these labels may well have been accidental, and, also, that there is no reason to suppose that Heckrath removed the
labels.
6. It appeared further in the Crown evidence that five of
the boxes seized could be unlocked by keys found in the bunch of
keys in Heckrath's possession. The others could be opened by keys in the possession of Rearden. The eighthbox could not be opened
by the keys in the possession of any of the defendants. The keys
found on Delcaire could not open any of the boxes. Heckrath and
Rearden in their evidence each of them offered an explanation of
the use of the keys found in their possession. But anyhow little
importance can be given to this item in the case for the Crown,
as it was proved also that five of these same boxes could be opened
by the use of keys in the possession of Mr. Jenkin, Barrister at
Law, who was engaged in the case for the defence.
7. It was admitted throughout that the three defendants
were acquaintances and were travelling together by arrangement.
It was admitted by a Police Sergeant (Pincett) in cross-
examination that a man named Sydney Cohen was personally known
to him as a dealer in illicit opium and that Cohen's servant had been charged recently with a breach of the Opium Ordinance in Hongkong, when opium attributed to Cohen had been found in his cust tody. The servant was tried by my colleague, Mr. J. R. Wood, and xé
was discharged on the ground that it was not proved by the Crown
that he knew what were the contents of the boxes placed in his charge. Sergeant Pincott also stated that Cohen held himself out to be connected with the Cinematograph Trade.
