Referring to the telegraphic correspondence

noted in the margin, I have the honour to

bring to your notice certain objections

which present themselves in the matter of

the proposed sale of the goodwill and trade marks of enemy firms in

liquidation.

It is most unlikely that at the present time a

bonafide purchaser would be forthcoming for such a name as Carlowitz or Siemssen; the only probable purchasers being Compra- -dores or other former servants of the firms, put up by their enemy principals in China to resuscitate the businesses and to foster them for the period of the war. For the present at all events the trade of enemy subjects has been destroyed in Hongkong and the goodwill of the businesses which they formerly carried on

to a great extent here has perished It would therefore seem unwise to attempt to

gather up and to revive any elements that may remain and to transfer them to persons whom we could not trust. In any case the liquidators could not deal with goodwill outside the Colony on which goodwill within the Colony so largely depends. Many former principals also of enemy firms have already made other arrangements for the carrying on of their agencies.

Trade marks and goodwill are of course intimately connected. Many enemy trade marks on the Hongkong
