With reference to your Despatch Confidential

of the 1st. October, 1915, I have the honour to submit for the simification of His Majesty's pleasure the following Ordinance intituled:-

The customary report by the Attorney-General

Major-General Kelly raised the question of the liability of soldiers to deportation and he was told that the point would be dealt with on the next occasion of amending the Ordinance.

This was afterwards decided to be unnecessary in view of section

144 of the Army Act, which must in any case over-ride a local

Ordinance.

llo reference has been made by the Attomey-

-General in his report to the mutter de-lt with in your Confidenti-

-al Dospatch of the 21st. August last because he was doubtful

how far it was proper to refer in the formal report on the Ordi-

-nance to the details of a Confidential Despatch of the nature of

that in question. The reasons for thinking that the legislation proposed was necessary were as foolowe. The doubt as to whether the legislation was necessary was apparently based on the state-
