Sir:-

I am directed by Secretary Sir E. Grey to trans-

mit herewith copy of a revised draft of the proposed

China (Companies) Order in Council, the amendments

now introduced in which represent the result of un-

official discussions between the Controller of the

Companies Department of the Board of Trade, the Legal

Adviser to the Colonial Office and the Assistant Legal

Adviser to this Department.

It will be observed that the definition Hong

Kong Company" has been altered to "Hong Kong China

Company", and that also a new Article 14 has been in-

serted to provide for the inclusion in the Order of

companies limited by guarantee, the necessity for

which has been strongly pressed by the responsible

authorities in China. The proposals embodied in this

Article appear to be the only way of avoiding the dif-

ficulties that would otherwise have arisen in regard
