Your despatch of November 4th Confidential, Moral

claims of consignees of condemned cargo. Answers to quest-

ions in paragraph 20 as follows:-

(1). No.

(2). Does not arise.

(3). (4). and (5). Firms in Hongkong with enemy partners which are in liquidation should be treated as British for the present purpose but where goods under lien to licensed bank and bills not paid surplus credits to liquidator but adjudicated on by Prize Court. Where bills accepted and paid since outbreak of war consignee should only be re-imbursed amount paid in respect of bill and surplus if any should be adjudicated on since in that case property will not have been passed to consignee. As to (5) surplus may be released in class E since property presumably in consignee at outbreak of war. As to class F proceeds may be released.

Question (6). No distinction should be made between solvent and insolvent firms.

In all cases where prize proceedings necessary these need not be instituted till after sale provided goods seized as prize before sale and sold with written consent of proper officer.
