found that they could not be brought into line with the more modern Instruments unless the L.P. were also amended. Drafts of both are therefore submit- ted.

CLAUSE X XI & XII. (ASSENT TO BILLS, RESERVED
BILLS: GOVERNOR & L.C. TO OBSERVE INSTRUCTIONS.) are taken from the Gambia L.P. Similar clauses also occur in the Straits L.P. ? Adopt them.
CLAUSE XV. (PARTON). "Crime or offence" is now generally referred to.
CLAUSE XVI. (DISMISSAL AND SUSPENSION OF OFFICERS) Has been brought into line with Colonial Regula- tions and a reference to dollars as well as pounds sterling inserted as in the corresponding Clause in the Straits L.P. It was decided in 1888 that $600 was to be inserted when the L.P. were revised,

CLAUSE XVII. ___ (SUCCESSION TO GOVERNMENT) The exist- ing Dormant Commission vests the succession in the Colonial Secretary for the time being, or the Senior Military Officer. Failing such a Commtssion the succession would under this Clause revert to the
person lawfully discharging the functions of Colonial Secretary. ? No change is necessary.
There is no provision in the L.P. for the appointment of a deputy to the Governor. Possibly the need does not arise in Hong Kong.

Straite Clauses have been adapted. The Governor in
pursuance of instructions now has power to make
definitive appointments, but the power to appoint
by Royal Warrant has been retained, though in practice
it would be rarely used.
Under the old clause a Public Officer may be
appointed to act as an Unofficial Member. I have
never noticed such a provision elsewhere. ? It should
not be retained,
CLAUSES V AND XX. PRECEDENCE IN EXECUTIVE AND
LEGISLATIVE COUNCILS. The precedence assigned by existing Instructions to the Treasurer
was modified by despatch 'General' of 3rd February, 1897 (copy annexed). That is probably out of date now, but the Governor's attention had better be
called
