With regard to your telegram of 22nd October i would first suggest that the simplest way of enforcing the Proclamation as regards paragraphs 1, 2 and 3 would seem to be to prohibit the exportation from the Colony of all goods destined for or shipped from China or Siam unless the con- sent of the Customs authorities has been obtained. The necessary prohibition could be issued under the Order-in- Council of 26th October, 1896, as amended by the Order-in- Council of 28th August, 1914, apparently. If you are advised that this power is not sufficient you should take power by means of legislation, In cases where the question of Prise Court proceedings arise you should, while detaining the goods under the prohibition, make enquiry as to the avail- ability of the necessary evidence. Instructions have been given to the British Kinister at Langkok to report to you by telegraph any cause where it is his desire that you should prevent tranehipment and which the Black and White List system does not covar, such as the case of Jarkwald mention- ed in mykelegram of 13th loveatur, and you should act in accordance. The Order-in-Council of 11th March may be neglected for the present purpose, it is not being enforced on the China coast, with regard to paragraph 4 of your telegram the situation of goods passing through the waters of the Colony is, it is thought, different in a material respect from that of gode larded for transhipment. This matter is however being reconsidered and I will as soon as possible address you on the subject.
