"It is not intended that liquidators should be

prevented from accepting agencies formerly held

by the alien enemy firms".

This circumlocution is nothing else than the formal

authorisation for which Mr. Hewett, Chairman of the Chamber of

Commerce had urged, namely:-

"To capture the Trade of the Enemy

and therefore German trade has been outlawed in Hongkong.

Further it must be noted that demands from Englishmen

outside the Colony can be made effective in Hongkong against a

Germm firm, which were not originally against the Hongkong firm, but against one of their branches in China and elsewhereal though according to German law these are altogether or partly not action-

-able. In addition to such damage to German interests extraordina-

-ry losses arise therefrom such as differences in Exchange.

That the German firms will be deprived of any protection

is obvious from the fact that the liquidators are expressly re-

-lieved from all liability for their actions except such as may be

criminal, and so many an apparently fair provision is rendered not

only completely worthless but any action, either on a large or

small scale, against the present or future interests of our firm,

is sanctioned.

As the profit on metals, shirtings and other trade goods

amounts usually to only from 1 to 2%, the liquidators' remunera-

-tion of 24% on the total, which can be increased at the dis-

-cretion of the Governor, is quite out of proportion to the

customary profit in ordinary business and to the work done, for

this is free from all risks and consists for the most part in

delivering the goods and collecting the money, which is done by the Compradores so that on the liquidators actually only falls the trouble of keeping accounts. As all expenses and salaries for compradores and assistants are paid by our firms, this remunera- -tion is net profit, but for us dead loss.
