to supplying and obtaining goods, but there is possibly some authority for the view that such agencies may be continued in so far as they relate to the collection and preservation, though not to the transmission, of money or property. In any case I think that no action should be taken against such donduct of an agency which was in existence at the commencement of the war. Even such a limited agency, however, if accepted after the outbreak of the war would be a breach of the law.

Banking Operations.

15. The common law on this subject is very uncertain, especially in view of the modern developments of banking. None of the questions relating to banking are settled since there are no de- -cided cases. Some of the following rules must therefore be re- -garded as not free from doubt.

16. No transaction of any kind which appears likely to result in aid or assistance to His Majesty's enemies should be entertained. The banks should make full enquiries into each case so as to avoid entertaining any such transaction, and any request on the part of other branches or banks in German territory to make special pay- -ments on their behalf by draft or cable transfer or otherwise

should be carefully scrutinised.

17. The banks should refrain from negotiating or dealing with Bills of Exchange or other instruments comected with the forward- -ing of merchandise to German territory or otherwise in aid of trading with the enemy.

18. The above rules seem to be clear. What follows is perhaps

more debatable.

19. I have already expressed the opinion that trading with local branches of firms domiciled in German territory is on the same footing as trading direct with persons resident in German territory

If that view be correct, as I believe it is, the banks cannot enter into any new relations with such local branches without

contravening the law.
