Sir,
It will be within Your Honour's recollection
that in October 1912 one R.H.B. Mitchell was convicted
before you at Tientsin of larcency and sentenced to 18 months imprisonment in Hongkong, with deportation to the United Kingdom at the expiration of his sentence.
The fact was over-looked by the Authorities in this Colony that there was no power to deport Mitchell to the United Kingdom and that, in order that effect might by given to Your Honour's sentence, the prisoner should have been sent back to Shanghai before the expiration of
his sentence.
As this was not done and as there is no objec-
tion on the part of the Police to Mitchell remaining in the Colony I propose, with your concurrence, to take no further steps in the matter of his deportation.
I have to express regret that proper steps were not taken to give effect to the sentence imposed upon Kitchell. I propose that in all cases of a similar nature the prisoner should be sent back to Shanghai befor the expiration of his sentence and I shall be glad to learn whether Your Honour concurs that this is the prope
course.
