The law of Hongkong is English law, save as
varied or added to by local Ordinances, and, I think,
therefore that the doctrine of bona vacantia applies,
and that the Crown is entitled to these shares.
Ford also owned some property in Yokohama consist-
ing of perpetual leaseholds. If this tenure is really
of the nature of a fee simple subject to a chief rent,
it is, on the view which I have expressed above, not
subject to escheat.
If it is leasehold and therefore personalty, it
is clearly locally situate in Yokohama, and not, on the
principle of Re Barnett's Trusts liable to be seized
by the Crown as bona vacantia: but by the Japanese (1f
by any) fiscal authority. Unless indeed it be main-
tained, which seems a startling proposition, that
because at the date of Ford's death, the extra-
territorial régime still prevailed in Japan, these lease-
holds must be deemed to have been locally situated in
England.
I think it is clear that great difficulties sur-
round the problem of whether the Crown is entitled to
claim any of Ford's immoveable property (whether free-
hold
