branches in China of firms which have partners and establish-
ments in enemy territory. In the attached opinion of Mr. H.
P. Wilkinson, a copy of which was enclosed in the letter of
K.B.M's Consul at Kiungehow to the Colonial Secretary dated
the 24th November, the view seena to be expressed that German
and Austrian subjects trading in China bear an enemy character
in respect of such trade. With the greatest respect to Mr.
Wilkinson'a opinion, in view both of his personal reputation
and of his familiarity with exterritorial problems, this
opinion, if correctly stated, seems difficult to reconcile
with the definition of "enemy" in the Trading with Enemy Pro-
clamation No. 2, and it does not seem to be in agreement with
the enclosed Foreign Office notification. It is recognised
of course that the position of the German and Austrian fires
in China differs in practical ways from the position of German d
and Austrian firms in neutral states where exterritorial
jurisdiction does not exist. The apparent divergence between Hi
Wilkinson's opinion andthis notification is indeed my main
reason for addressing you, as I am anxious to ascertain what
is your present policy on this matter.
I therefore have the honour to as you if you will
be good enough to inform me as to what view you take on the
status of the German and Austrian firms in China, whether
purely local or branches of firms in enemy territory.
At
the same time I shall be very glad of any observations which
you may care to make on the other matters referred to above.
