I have the honour to submit for your consideration

the enclosed copy of correspondence which has passed between the General Officer Commanding and myself, after we had discussed the matter and mutually agreed to refer the question for your decision concerning the interpretation of Clause III section 1 of the Order-in-Council of the 26th of October, 1896, which was published by Proclamation copy of which was enclosed in my secret despatch of the 12th August.

Several cases have already arisen in which premises

have been illegally, as I am advised, entered and searched and

persons arrested therein by order of the Provost Harshal or of

another Military Officer on mere suspicion for which there was no

foundation or on the ples of stopping such noises as singing; and it was the discovery on discussing these cases with Major-General

Kelly that he considered the action taken to be legal, that has led to this reference to you.

I need hardly remind you that in a Colony populated

by an alien and timid race like the Chinese the exercise of auch

wide powers as Major-General Kelly claims might lead to disastrous

results.

4.

There is another question which arises out of the

same difference of opinion. I recently put the question to Major-

General Kelly as to what his view was as to the action to be taken
