THUCOFAH

August 27th. Referring to declaration of London contained in command papers 4554 which was communicated to you by Colonial Office Library April 2nd 1909 Order in Council dated 20th August adopte declaration of London during hostilities subject to follow- ing modifications.

1. Substitute contraband lists contained in Proclamation of August 4th 1914 for lists in Articles 22, 24 of declaration.

2. Neutral vessel which have carried contraband to the enemy with false papers may be detained if encountered before completing return voyage.

3. Destinations referred to in Article 33 it may be inferred from any sufficient evidence and in addition presumption contained in Article 34 shall be presumed to exist if goods are consigned to or for agents of or persons under control of authorities of enemy state.

4. Existence of blockade presumed to be known to all ships which have left or touched at enemy port a sufficient time after notification of blockade to local authorities to have enabled enemy Government to notify existence of blockade or which have left or touched at British or allied port after publication of declaration.

Notwithstanding provisions of Article 35 conditional on contraband shew to have destination indicated in Article 33 may be captured to whatever port vessel is bound and at whatever port cargo is to be discharged.

General reports (on) to Naval Conference printed in com- mand paper 4554 shall be considered by all Prize Courts as authori- tative statement of meaning and intention of declaration and provi- sions of declaration shall be interpreted as in the light of com- mentary given therein. Despatch follows by mail.
