E.P.C.Miller put the magazine into his pistol, loaded the chamber, applied the safety catch and left the hammer cocked The pistol, if in proper working order would be quite safe. After putting into the holster he proceeded to put the hol- ater on to his belt. The loops on the pistol holsters are
rather small and some pressure is necessary to send the metal fastening of the duty belt through the holster loop. In doing this B.P.C.Miller must have applied pressure to the hammer, causing it to spring to the firing pin and discharge the pistol, which the constable was holding near
