With reference to your despatch No.358 of the

22nd of November, 1913, I have the honour to enquire whether

any answer has been received from the Army Council on the sub- ject of the proposals made in Sir F. Lugard's despatch No.31 of

72- the 17th of January, 1912.

In March last application was made for the lease

of an area of Crown land situated on the landward side of the

battery at Mount Davis within the proposed clearance area for

the purposes of building a private residence.

Enquiry was made of the Military Authorities as

to whether there was any objection to the proposed building and

they have replied that there is none "provided it is understood

that the War Department accept no responsibility for damage "done by gun fire in peace or war and that it is further under- "stood that in the event of actual hostilities the occupier

"will be liable to be turned out of his house without compensa-

"tion".

As the guns of the battery could not be fired landwards the condition regarding damage by gun fire would apply only in cases of damage by concussion a contingency easily avoided in this instance by the opening of windows.
