"and provided also that in any case in which the prson is brought before the Magistrate on any such charge the Ma- -gistrate may, if he thinks fit, deal summarily with the case and sentence such person to imprisonment for any term not exceeding one year"

The matter is of some importance really for two reasons;-
Firstly, because the Magistrates frequently send up these cases to the Sessions and these cases are very frequently, and in fact one might say in most cases, matters which might well be dealt with by the Magistracy summarily; one does not want the Sessions choked with cases which may fairly be regarded within Magisterial jurisdiction:
Secondly, and this is more important, you will observe that under Section 85 of the Magistrates Ordinance, 1890, as it now stands enacted by Section 2 of the Magistrates Amendment Ordinance, 1913, the Magistrates have power to order a person who is con- -victed of returning from banishment contrary to the provisions of Section 8 of the Deportation Ordinance, 1912, to be flogged in certain cases; but, as the Magistrates think that they cannot deal summarily with a returned Banishee unless he pleads guilty, this invaluable power of flogging which the Magistrates have in this class of cases is of no use unless the man in fact pleads guilty.
