It is agreed by the learned counsel on both sides that
it will be for the Exmuti executive authorities to consider
whether the requisition for the surrender of the fugitive
has in fact been made with a view to try and punish him for
an offence of a political character.
The fugitive is now therefore formally discharged on
the 2nd charge and committed to prison on the remaining four
charges to await the further order of the Governor.
