I, George Gogkle, L. S. A. 50 do hereby certify

that by virtue of the within warrant I arrested

the within named Chung Hsiu Nam alias Ohung Sau

at Victoria in this Colony at 10.45 a.m. on the

5th. inst.

In this matter the present Governor General of the Kwong Tung Province has applied to the Governor of Hong Kong through the Consul General in Canton for the surrender of a fugitive named Chung Sau Nam. Two requisitions of the Govern- or General dated 29th. October 1913 and 20th. November 1913 respectively are in the record and are marked Exhibita Fos. 29 & 3 (Translations: Exhibits 30 & 4). On receipt of these requisitions orders dated the 11th. November 1913 and the 2nd. December 1913 were issued by the officer Administering the Government to the Magistrates. They havebeen marked Exhibits 6 & 5. The fugitive was arrested on the 18th. November 1913 on the Magistrate's warrant marked Exhibit 1. The present enquiry follows on that warrant and on the Mag- istrate's order to bring up the fugitive, which is marked Exhibit 2.

The fugitive was before the Court for the first time on the 19th. November. The Counsel for the Crown submitted two charges against him to which he was asked to plead. Ho formally pleaded: "Autrefois Acquit".

The enquiry was proceeded with on the 9th.December. The Counsel for the Crown substituted five charges for the two originally on the record. He intimated that these five charges were intended as an indication of the scope of the evidence, which the Crown proposed to offer. The fugitive was not asked to plead to these five charges. His earlier plea of "Autrefois Acquit" was abandoned.
