by me has been proved to be incredible by the fact that he has been contradicted by his two Deputies in that resect and I request the Committee to seriously consider the question as to why br. Niabet should have denied knowledge of this fact. I submit that he has been actuated by ill-feeling towards me which ill-feeling I struggled hard to disclose in the course of the cross-examination of Mr. Nisbet by me but the Committee would not permit me to do so as it was of the opinion that gentleman of Mr. Nisbet's clase could not be actuated and subordinates were wrong in coming to that supposition. I admit this but with exception, if I may say so. I regret to have to refer to the question of actuation on the part of Mr. Nisbet, but it is unavoidable for the purposes of my defence as a whole bar to the money order cash.

I respectfully submit that if Er. lisbet could see his way to denying knowledge of one fact he could be assumed to be wrong in denying knowledge of other fate and the statement or statements in conection therewith should not be weighed with the same amount of confidence as if the statement or statements had not been contra- -dicted and more especially by the Assistant Heeds of Department, viz.:- his two Deputies.

Practice as to receivin fees in advance in pauper cases. This practice was created in the time of Lr. Seth about 1908 and nad been in force ever since in the Registry. It has now been sade the prastics of the Rezistry under an order of the Court in

Probate matters including payver oases and ag under considera- -tion of the Law Society of Hongkonɛ at the instance of the Registrar, Mr. Nisbet, previous to the 30th. of June last. The Registrar must have had the question of taking fees in advance in Probate matters wder his consideration for some time before he could have submitted it to the Law Society. It was undoubtedly the most wise and convenie t course in ever, respect in Frobate matters and it has been proved beyond any shadow of doubt, to be so by the fact that the Registrar himself as now adopted it under an order of the Court after my tar transfer from the Registry.
