at pending cases. There are stamps on declarations (2) of the Printers and Publishers register in which stamps paid in March were not cancelled till 4th July: I think the 4th. July was the date
when Alim Khan paid the money (82 in all). The Auditor looked at
the fee-books (I have asked him).
There was a case in which stamps were on the file but had not
been cancelled; it was a long time, perhaps a year or more: this was an oversight. In Shek Fuk's case I was wrong as there is no entry in the Fee-book but there is an entry in the Probate (on
Petition) register dated 8th. May, 1913.
I don't know if this Probate register was sent out as a
Chit Book. I never knew cash was paid to any clerk for copying
fees: open cheques may have been sent to me when the amounts were
big by Solicitors. I do not remember sending these cheques to the
clerks. In Company cases I don't remember holding up monies, I
don't remember Mr. McElderry reporting to me in Lay that you had reported to him that you were holding up the money inpauper cases.
Gabnava Singh's case:letters of administration: an Indien died and
he had a wife in India: I was official administrator: amount due ti
estate #213.19; a cheque for this amount was received from Treasur;
by me on or about 17th. pril, 1913: I sent the cheque with the direction to the shroff who returned it to me chopped; chopped on
the receipt and on the cheque for me to endorse the cheque and
sign receipt: I endorsed the cheque (Order cheque) and landed it
to the No. 1 messenger to give to the shroff. It was one of Mr.
McElderry's cases.
I received a letter dated 31st. July, 1913, from Deputy
Commissioner at Hoshiarpur (marked F).
I answered it (letter not produced).
I received a reply covered a document dated 17th. April, 1915, purporting to be signed by lr. McElderry (marked G).
