discrepancy. liis back was now to the wall. He had, on the advice
of his Counsel, repaid the money in respect of which criminal
proceedings had been instituted, hoping no doubt thereby to avoid a conviction and in fact a nolle prosequi was entered
; and he similarly hoped that if he sent the balance of the money to India
he might escape a further criminal charge, remembering perhaps a recent and well-known cuse in which the repayment of a sua of some thousands of dollars misappropriated led to the discharge of the defendant without further proceedings. He accordingly managed by solie means to obtain the sum required and he despatched the Loney
to Hoshiarpur.

To sum the whole matter up, I am satisfied that
all three charges are fully proved; that Alim Khan did improperly
retain money in respect of certain estates with the intention of
accounting for it only when compelled by circumstances to do so;
that he did retain the remitunco destined for India with the
intention of misappropriating. if possible, the whole, or, if that¡
could not be managed, auch portion as the event migit show he
could safely keep without detection.
