Sir:-
With reference to the Note which you were good
enough to address to me on September 12th on the sub-
ject of the desired extradition from Hong Kong of
Vicente Sotto, I have the honour to acquaint you with
the contents of a despatch from the Consul General at
Hong Kong to the Secretary of State which has just been
transmitted to me with instructions to invite your
attention to a condition to which the action of the
Crown authorities at Hong Kong has given rise.
The Consul General reports under date of September
13th last that he has been summoned in a suit on Sotto's
behalf against him officially for the penalty pro-
vided under Section 5 of the British Habeas Corpus Act,
the suit being brought on grounds similar to those of
the suit against Mr. Vice-Consul-General Sawyer for
his action in behalf of the Philippine Government last
