Sir:-
With reference to Mr.Maycock's note of April Zöth
addressed to Mr.Laughlin on the subject of the extrad1-
tion of Vicente Sotto from Hongkong in which he said
that "we consider that the decision of the High Court in
the case of Rex versus Governor of Brixton Prison ex
parte Stallman may be taken as a judicial authority for
holding that an accused person committed for extradition
but released on habeas corpus on account of some defect
in procedure may be proceeded against again with a view
to extradition on same charge as before", I have the
honour to inform you that the Secretary of State has
received a report from the Consul General at Hongkong to
the effect that Sotto has been released by the Magis-
trate in Hongkong on the ground of res judicata.
In inviting your attention to this decision,
which
16 contrary to the case cited in Mr.Maycock's note,
I
venture also to advert to Mr.Maycock's statement that
it
