With reference to Despatch No. 292 of the

13th. August, I have the honour to state for purposes of future

record that Mr. C. Clementi is entitled to a pension of £1,717.88

at 3/- to the dollar from the Widows and Orphans' Pension Fund of this Colony, based on his present contribution of $204 per annum which must be continued for 35 years from the 20th. December, 1899,

i.e. until the 19th. December, 1934, (section 9 (1) of Ordinance 15

of 1908).

In this connection it is necessary to decide at what rate of exchange the sum of 8204 should in future be paid. An officer with exchange compensation has, while in the Colony, the privilege of contributing at the rate of exchange of the day, although the pension is at the rate of 3/-, but when he is on leave or on pension he contributes at the rate of 3/- to the dollar, o.g. Mr. Clementi in the Colony contributes 8204 mexican and on leave $204 at 37- Section 12 of Ordinance 15 of 1908 provides that an

officer transferred elsewhere may continue to contribute at the same rate and subject to the same terms as if he had continued in the service of this Government; but, as kir. Clementi contributes at two rates, this section is not decisive on the point.

There is no local precedent which covers this question, and I shall therefore be glad of a ruling for the case
