With reference to your letter No. 134/1906, dated 9th. instant, I now agree that it being necessary to entirely exclude the public from the land taken up for Battery construction at Mount Davis, no part thereof could fairly be considered as a
mere reserve, and the necessary ground should be acquired by the War Department.
But as regards the quotation from the despatch of the Secretary of State dated 24th. October, 1900, I observe that it is stated therein that "lands purchased from private persons will "become the property of the War Department and lands belonging to "Colonial Government should be similarly treated".
This wording appears t be at variance with the con- -tention of the Colonial Government in recent correspondence, that all lands acquired from that Government are only in "perpetual user" and can only be dealt with as laid down in Colonial Office
Circulars.
I have no desire to reopen this question, but mere- -ly to point out that the word "property" appears to be used in its ordinary sense.
A further communication will be made as to the slightly reduced area actually required, and the price, which appears reasonable to this Department.
