on An Ordinance entitled An Ordinance to amend the New Territories Regulation

Ordinance, 1910,

The object of this Ordinance is to endeavour to bring

under proper control, and similarly to provide for the future, the

markets in the New Territories. A few already exist but they

are under no proper supervision and the Government has no prac-

tical authority over them. In time to come no doubt other

markets will be established in suitable places.

It was thought

that the simplest way of dealing with this matter was to add the

necessary provisions to the New Territories Regulation Ordinance,

1910. The object being to keep, so far as possible contained

in one Ordinance the administrative arrangements applicable to

this particular part of the Colony.

Section 1 of the Ordinance is formal.

Section 2 of the Ordinance repeals the definition of

land contained in the New Territories Regulation Ordinance, 1910 (Ordinance No.34 of 1910) and replaces it by a new definition

which now includes market building and any rent or profit aris-

ing therefrom. The object of this is to put the market buildings

and any rent or profit arising therefrom on the same footing as

land as defined in the Ordinance and to bring such under the di-

VL rect administrati powers of the District Officers in the settle- ment of any disputes in connection therewith.

By Section 3 of the Ordinance, Section 6 of the Principal Ordinance is amplified. Section 6 of the original Ordinance gave

power to the Governor-in-Council to make various rules in connection

with Revenue matters, taxes, contributions and the like; under the

bas amplification of the present Ordinance, the Governor-in-Council is given power by notification in the Gazette and suitable Chinese

publication

Under

(a) to declare that any specified place shall be

the market for any area within the New Terri-

tories (exclusive of New Kowloon which dis-

trict is not included in the scope of the

present Ordinance)

(b) to determine the boundaries of such declared

market

(c) to fix the boundaries of the area for which

such declared market shall be the market.

be the market for a particular area; a certain locality or spot in

minal area for which the market is to serve be definitely des-

cribed and determined.

(d) to make rules prescribing the character of market

buildings, providing for market management and

inspection, prohibiting the sale within any area

served by a declared market of any commodity un-

less sold in the proper market place; prescribing

the kind of commodity which may be sold and where;

providing for the sanitary maintenance of the con-

ander ditions which the market is conducted; providing

for the control and appropriation of market funds

and for the fees to be taken for the purpose of

maintainin a market property; and finally pres-

cribing any other requisite matter necessary or

desirable in the interests of sanitation or good

order of the market3.

Under the powers given in paragraph (d) it will be possible
